Use MindPhase responsibly.

By accessing MindPhase you confirm that you can form a binding contract with Vigilainte Inc., and that you accept these Terms as well as our Privacy Policy. If you do not agree, discontinue use immediately. Continued use after we post updates means you accept the revised Terms.

You must be old enough to use MindPhase under the laws of your jurisdiction (typically 13-16 years old). If you are under your local age of majority, a parent or guardian must review and agree on your behalf.

MindPhase does not require a traditional account. Instead, we generate a random identifier when you first launch the app.

• Keep your device secure - anyone with access to it can use MindPhase under your identifier.
• If you lose access to your identifier (for example, by deleting the app or clearing data), you may lose edit history or credits tied to it.
• Email onur@mindphase.app if you need help migrating or deleting an identifier.

MindPhase uses credits to run edits. Credits may be granted, purchased, or bundled with other offerings.

• RevenueCat manages purchases and balances. Platform billing terms (such as the App Store) apply.
• Credits may expire or change with notice. Promotional credits can be revoked if issued in error.
• Vigilainte Inc. may update prices or packages at any time. We will honor credits already in your balance.
• For refunds, please follow the process of the marketplace where you purchased credits.

• You retain ownership of the photos, prompts, and outputs you upload or generate.
• You grant Vigilainte Inc. a limited, worldwide, non-exclusive license to store, process, and transmit your content solely to operate, maintain, and improve MindPhase.
• Do not upload anything illegal, harmful, or protected by intellectual property you do not own.
• We may remove content that violates these Terms or applicable law.

MindPhase relies on partner technology to deliver edits quickly and reliably.

• fal.ai processes images and returns generated results based on your prompts.
• Supabase stores identifiers, metadata, and generated outputs.
• RevenueCat tracks purchases and credits.
• We plan to use analytics tools such as PostHog and Google Analytics, plus advertising SDKs from Google, Meta, and TikTok to measure marketing campaigns. Future integrations will respect our Privacy Policy.
• Third-party services may update their own terms and privacy notices - review them as needed.

You agree not to misuse MindPhase. In particular, you will not:

• Interfere with or disrupt servers, networks, or security features.
• Reverse engineer, decompile, or attempt to access source code except where the law allows.
• Upload malware, infringing content, or other harmful material.
• Use MindPhase for unlawful, discriminatory, or deceptive purposes.
• Attempt to bypass credit limits or manipulate billing.

We may suspend or terminate access if you violate these Terms, misuse the service, or create a security risk. You may stop using MindPhase at any time. Termination will not impact rights or obligations that by their nature should survive (for example, ownership of your content or our disclaimers).

MindPhase is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Vigilainte Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted or error-free service, nor the accuracy or suitability of AI outputs. Vigilainte Inc. will not be liable for any indirect, incidental, or consequential damages arising from your use of MindPhase. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

You agree to defend, indemnify, and hold harmless Vigilainte Inc. and its affiliates from any claims or expenses (including reasonable attorneys' fees) arising out of your misuse of MindPhase or violation of these Terms.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.

We may update these Terms from time to time. When we do, we will revise the "Effective date" above. Material changes will be noted in the app or via other communications. Continued use of MindPhase after changes become effective constitutes acceptance.
